The Pune Civil Court on Friday finally put its seal on the legal cancellation of the sale deed regarding the land transaction of the Sheth Hirachand Nemchand Digambar Jain Boarding.
PUNE, 15 NOV. The Pune Civil Court on Friday finally put its seal on the legal cancellation of the sale deed regarding the land transaction of the Sheth Hirachand Nemchand Digambar Jain Boarding. The purchase deed, which was registered on October 8, involved the sale of a three-acre plot belonging to the public memorial trust for ₹231 crore to Gokhale LLP, and the deal had sparked a major controversy.
The Jain community vehemently opposed the land sale, with a large-scale agitation organized under the guidance of Acharya Shri Guptinandi Ji Maharaj, arguing that the transaction was illegal. Due to the aggressive stance of the Jain community, the builder, Vishal Gokhale, subsequently announced his withdrawal from the project.
Following this, the Hirachand Nemchand Smarak Trust and Gokhale Builder jointly submitted an affidavit to the Charity Commissioner's office in Mumbai on October 30 to cancel the land transaction. The Charity Commissioner's order allowing the trust to sell the land, which was issued on April 4, was then revoked on October 30. Subsequently, the Trust and Gokhale Builder filed an application in the Pune Civil Court seeking the cancellation of the purchase deed. Civil Judge N. R. Gajbhiye heard the application and issued an order to cancel the sale deed, confirming that the sale transaction was now void. Advocates Ishan Kolatkar represented the Trust, and Advocate Nischal Anand represented Gokhale Builder, while members of the Sakal Jain Samaj were also present during the proceedings.
